1. General Conditions of Use

a. Scope and Definitions

These General Conditions of Use govern the use of all services provided by ZipTix, a carpooling service that connects drivers and passengers for shared rides. By using our platform, you agree to comply with these terms.

Definitions:
Carpooling: The act of sharing a ride in a vehicle, where a driver (Car Owner) offers a ride to one or more passengers (Co-Travellers) in exchange for a contribution toward the trip's costs.
Conditions: These General Conditions of Use, including the Good Conduct Charter and Privacy Policy as provided on the ZipTix website.
Cost Contribution: The agreed amount that a passenger pays to the driver to cover their share of the travel expenses for the trip.
Co-Traveller or Passenger: A registered user who accepts a ride from a driver through the ZipTix platform, including any additional passengers accompanying them.
Car Owner or Driver: A registered user who offers a car ride to other users through the ZipTix platform in return for a Cost Contribution.
Member: Any user registered on the ZipTix website or app.
Service: The carpooling services provided by ZipTix through its website and mobile application.
Site: The official website of ZipTix, located at www.ZipTix.in, and any associated mobile applications.
Trip: A journey arranged through ZipTix, where a Car Owner and a Co-Traveller agree to share a ride.
User Account: An account created by a Member on the ZipTix website or app to access the services provided by ZipTix.
Vehicle: The car offered by a Car Owner for a carpooling trip.

b. Acceptance of Conditions

By accessing and using the ZipTix platform, you fully accept and agree to be bound by these Conditions. These Conditions apply to all Members, and you cannot use our services unless you accept them in full.

  • Binding Agreement: Your use of the ZipTix website or app constitutes your agreement to these terms. If you do not agree to these Conditions, you should not use our services.
  • Entire Agreement: You must accept all the terms within these Conditions; partial acceptance is not permitted.
  • Data Processing: By agreeing to these Conditions, you also agree that your personal data may be processed in accordance with our Privacy Policy.
  • Consequences of Non-Compliance: If you fail to comply with any of these Conditions, ZipTix reserves the right to suspend or terminate your User Account and withdraw access to our services without notice.

c. Variation of the Conditions, Site, and Service

ZipTix reserves the right to modify these Conditions at any time. Additionally, we may change the services offered, the functionality of the website or app, or the overall look and feel of the platform without prior notice.

  • Modifications: Any changes to the Conditions, services, or the platform itself will take effect immediately upon being published on the ZipTix website.
  • Notification of Changes: We will notify Members of any significant changes by updating the Conditions on our website or app. It is your responsibility to review the Conditions regularly.
  • Continued Use: By continuing to use our services after any changes have been made, you are deemed to have accepted the updated Conditions. Any changes will not affect bookings made before the changes were published.

2. Using the Service

a. Creating and Managing Your Account

To access the services provided by ZipTix, you must create a User Account. You are responsible for ensuring that all information provided during registration and any updates to your account is accurate, complete, and up-to-date.

  • Account Security: You are responsible for maintaining the confidentiality of your login details and for any activities that occur under your account.
  • Accuracy: Providing false or misleading information may result in the suspension or termination of your account and access to ZipTix service.

b. Non-Commercial Use and Role of ZipTix

ZipTix is a platform that facilitates carpooling among individuals. It is not a commercial transportation service, and as such, Members (both Car Owners and Co-Travellers) must not use the platform for any commercial activities.

  • No Profit: Car Owners should not seek to make a profit from their carpooling activities. The Cost Contribution should only cover expenses related to the trip, such as fuel and tolls.
  • ZipTix's Role: ZipTix acts as a facilitator and is not responsible for the actions of its Members. ZipTix does not own, operate, or manage vehicles, nor does it provide transportation services.

c. Booking Options and Payment Methods

ZipTix offers various booking options to accommodate different user needs. Payments are typically made through the platform, and the following terms apply:

  • Booking Types: ZipTix offers to its Members an online booking service with a view to facilitate the booking of seats by Passengers.
  • Payment Methods: Payments can be made through the ZipTix platform using the payment methods available at the time of booking. The Cost Contribution is typically paid after the trip ends.
  • Cancellations and Refunds: Cancellation policies vary based on the timing of the cancellation and the type of booking. Members should review the cancellation policy before making a booking.

d. Responsibilities of Drivers and Passengers

Both Car Owners and Co-Travellers have certain obligations to ensure a smooth and safe carpooling experience:

Car Owner Obligations:
  • Ensure that your vehicle is in good working condition and meets all legal requirements.
  • Arrive at the agreed pick-up location on time.
  • Drive safely and adhere to all traffic laws.
  • Communicate any changes to the trip promptly to your Co-Travellers.
Co-Traveller Obligations:
  • Be punctual and respectful of the Car Owner's vehicle.
  • Pay the agreed Cost Contribution as per the booking details.
  • Inform the Car Owner of any changes to your plans as soon as possible.
  • Abide by any rules set by the Car Owner regarding behavior in the vehicle.

e. Insurance Requirements

Car Owners must ensure that their vehicle insurance is valid and covers carpooling activities. It is the Car Owner's responsibility to verify that their insurance policy permits the use of the vehicle for carpooling.

  • Coverage: The Car Owner's insurance should cover all occupants in the event of an accident. Co-Travellers should be aware of the insurance policy details before embarking on a trip.
  • Verification: ZipTix does not verify the insurance status of any vehicle or Member, and it is the Car Owner's responsibility to maintain adequate coverage.

f. Handling Disputes Between Users

ZipTix encourages Members to resolve disputes amicably through communication. Please remember that ZipTix doesn't intervene directly or indirectly between the parties in case where disputes cannot be resolved.

  • Account Action: In severe cases, ZipTix may suspend or terminate the accounts of Members involved in disputes.

g. ID and Phone Number Verification

For the safety and trust of the community, ZipTix may require verification of your identity and phone number at the time of registration.

  • ID Verification: You may be asked to upload a government-issued ID to confirm your identity. This is particularly important for Car Owners.
  • Phone Number Verification: A valid phone number is required for account creation, and you may be asked to verify this number periodically.

h. Communicating with Other Members

ZipTix provides a messaging platform to facilitate communication between Car Owners and Co-Travellers. The following guidelines apply:

  • Purpose: The messaging system should be used solely for arranging and discussing trips. It should not be used for any other purpose, including unsolicited promotions.
  • Respectful Communication: Members must communicate respectfully and professionally. Any abusive or inappropriate behavior may result in the suspension or termination of your account.

i. How Members Can Contact Each Other

Members can be contacted through the ZipTix platform for trip-related purposes. The following rules apply:

  • Privacy: Personal contact information should not be shared outside of the ZipTix platform. Communication should take place within the platform for security and privacy reasons.
  • Contact Limits: Members should not be contacted for reasons unrelated to carpooling. Any misuse of contact information will be considered a breach of these Conditions and may result in account suspension.

3. Disclaimer of Liability

ZipTix is a platform that facilitates carpooling by connecting drivers (Car Owners) and passengers (Co-Travellers). We act solely as an intermediary, providing a space where Members can arrange Trips with one another. As such, ZipTix is not liable or responsible for any actions, inactions, or conduct of Members, including but not limited to the behavior of Car Owners or Co-Travellers during a Trip. Members use the platform at their own risk, and any issues arising from the use of the service should be resolved directly between the involved parties.

ZipTix does not guarantee the accuracy, reliability, or completeness of any information provided by Members on the platform, including details about vehicles, routes, timing, or any other Trip-related information. We do not verify the information provided by Members and, therefore, cannot make any warranties or representations regarding its validity. Members are encouraged to verify all relevant details directly with each other before embarking on a Trip.

ZipTix does not enter into any contractual relationship with Members regarding the Trips facilitated through the platform. The agreement for each Trip is solely between the Car Owner and the Co-Traveller. ZipTix is not a party to any agreement made between Members, and as such, we do not assume any responsibility or liability for the fulfillment of such agreements. Members are fully responsible for negotiating and upholding the terms of their Trip.

ZipTix shall not be held liable for any loss, damage, injury, or inconvenience arising from the use of our platform or the participation in any Trip. This includes, but is not limited to, any direct, indirect, incidental, consequential, or punitive damages. Members acknowledge that they are solely responsible for ensuring their own safety and security during a Trip and for the protection of their personal property.

4. Your Responsibility and Release of Claims

As a user of ZipTix, you are responsible for your actions and interactions with other Members on the platform. By using ZipTix, you agree to the following responsibilities:

  • Conduct: You must conduct yourself in a respectful and lawful manner when interacting with other Members. This includes following traffic laws, ensuring your vehicle (if you're a Car Owner) is roadworthy, and adhering to the agreed-upon arrangements for any Trip.
  • Safety: You are responsible for your own safety and the safety of others while participating in any Trip arranged through ZipTix. This includes ensuring that you and any passengers are wearing seatbelts and that your vehicle is in proper working condition.
  • Release of Claims: By using ZipTix, you agree to release ZipTix from any claims, demands, or damages arising out of disputes with other Members or from your use of the platform. This means that you cannot hold ZipTix liable for any loss, injury, or inconvenience that may occur during a Trip.

5. General Terms and Conditions

a. Member Relationship with ZipTix

When you register and use ZipTix, you acknowledge that your relationship with ZipTix is that of an independent user. ZipTix is a platform that facilitates carpooling and does not form any contractual relationship between Members for the Trips arranged. There is no employment, partnership, joint venture, or agency relationship between you and ZipTix.

b. Suspension or Termination of Access

ZipTix reserves the right to suspend or terminate your access to the platform at its discretion. This action may be taken for reasons including, but not limited to, violation of these Terms and Conditions, fraudulent activity, or any behavior that threatens the safety or well-being of other Members. Suspension or termination may occur without prior notice, and you may lose access to your account and any associated benefits or data.

c. Intellectual Property Rights

All content on the ZipTix platform, including text, graphics, logos, icons, images, and software, is the property of ZipTix or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive license to access and use the platform for personal, non-commercial purposes. You may not copy, modify, distribute, or use any content from the platform without express written permission from ZipTix.

d. Member-Provided Content on the Site

Members may provide content to the ZipTix platform, such as trip details, reviews, and other information. By submitting content, you grant ZipTix a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media. You represent and warrant that you own or have the necessary rights to submit this content and that it does not infringe on the rights of any third party.

6. Applicable Law and Legal Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms and Conditions or your use of the ZipTix platform will be subject to the exclusive jurisdiction of the courts located in Malkajgiri, Telangana - India. By using ZipTix, you agree to submit to the personal jurisdiction of these courts for the resolution of any disputes.

7. Account Deletion

If you wish to delete your ZipTix account, you may do so by sending a request to our support team via email at contact@ziptix.in. Alternatively, you can reach out to us through our Contact Page. Upon receiving your request, we will verify your identity and proceed with the deletion process in accordance with our data retention policies. Please note that certain information may be retained for legal, regulatory, or security purposes as required by applicable law.
